Chapter 38.2 First dig a pit for Du Xinyi, then fill her with soil and lay her to rest.

Name:You're Fired! Author:酒煮核弹头
Whoever claims had to prove. Since Du Xinyi had to prove Dai Qin’s fraud on behalf of the company, she had to at least prove her subjective intent, which was not an easy task. Bai Duanduan had already thought of this allegation when she learned that Guifeng Communications was going to invalidate the contract for fraud on the grounds of information concealment at the time of entry into the company.

However, in the face of Bai Duanduan’s refute, Du Xinyi was not slow this time. As if she was waiting for Bai Duanduan to react in this way, she looked at her with a pitying and contemptuous look, and then took out the tape recorder, “Your client doesn’t know she’s pregnant? Heh, then, Lawyer Bai, how about listening to this?”

Du Xinyi pressed the switch, and after a murmur in the recorder, there was Dai Qin’s faint sobbing voice —

“Sister Wanjun, I really didn’t mean to take sick leave on purpose. I really had to take such a leave because the baby’s condition was not good.”

The next thing that rang out was a slightly subdued female voice, with a touch of reassurance and full of sympathy, “I know, Xiao Dai, if you weren’t in a bad situation, you certainly wouldn’t want to take time off. I’m also an experienced person, and I know that the baby’s condition is unstable in the first trimester. It’s easy to fall ill because of morning sickness so it’s actually best to rest at home for the whole time to settle the pregnancy……”

This was obviously Li Wanjun, the HR director, who was rambling on about the dos and don’ts of safe motherhood. She was an older woman, and with her popular friendly face, even Bai Duanduan couldn’t help but feel close to her when she listened to the recording. It’s just that those who can take up the position of personnel director at a large company were not likely to be any good old people.

As expected, after softening Dai Qin’s heart, Li Wanjun finally began to meander forward, “Girl, you’re really something! If you were pregnant in the first place, why did you still think of coming to work with us? Your position is already particularly stressful, and this is not conducive to nurturing the baby. I think you should have chosen an easy position for the interview in the first place. And coming out to work like this, isn’t this harming yourself?”

This was one of HR’s most handy conversation traps, yet Dai Qin apparently didn’t even realize the trap in Li Wanjun’s words. She honestly followed the other party’s meaning and admitted her knowledge of being pregnant at the time of joining, “Because I do like the job and I really wanted to fight for it. Even though I’m pregnant, I’m still young after all, and I also want to have prospects in the workplace, and I wanted to get the job before I have a baby.”

Dai Qin’s tone was sincere and heartfelt, she didn’t expect that this was all a ruse used by personnel head to fire employees at the lowest possible cost, ; “Sister Wanjun, believe me, I am really not the kind of person who thinks of living comfortably every day after being pregnant and giving birth. I really want to have a career. It’s just that the child’s situation is not good now but when it stabilizes afterwards I will come to work. I will also definitely cooperate fully with the company’s need to work overtime after I have the baby……”

At that point, without further ado, Du Xinyi, with a victorious expression on her face, pressed the recorder to stop, “Is there anything else that Lawyer Bai and Miss Dai would like to say? On another note, this conversation took place in this conference room, and if Lawyer Bai has any objections to the authenticity, we have video footage of the whole thing as well.”

Once a labour dispute arises between the employee and the company and enters into personnel negotiations, one should in fact be very careful and beware of many leading questions, but unfortunately Dai Qin was in the end too young and too trusting of Li Wanjun.

Knowing that her excessive naivety had spoiled things, Dai Qin was crestfallen. In fact, ever since the video that caused a huge discussion on Weibo came out, she realised that she had mistakenly trusted Li Wanjun, yet everything had already happened……

She looked towards Li Wanjun, her voice choked with sobs, “Sister Wanjun, I really treated you like my own elder sister before I said it all. If it were anyone else, I wouldn’t have told the truth, I really thought you would understand me…..”

Unfortunately, Dai Qin’s words did not elicit any sympathy from Li Wanjun, and it was only then, sitting at the negotiating table, that this middle-aged woman, who looked like a good old lady before, showed her sharp side. Her usual friendly face finally showed her true expression that was total disapproval of Dai Qin, “Dai Qin, you just cheated the company and went too far. Even if you conceal your pregnancy to join us, as long as you worked hard and did a good job afterwards, our personnel would not have taken such an extreme response. But you took leave directly after your probationary period was over which was unbearable because you did not do your part, so I had to do what I should have done within my part.”

Li Wanjun clearly disagreed with Dai Qin not only from her work standpoint, but from her own personal standpoint also, she was very dismissive of her, “It was at Guifeng that I got pregnant and gave birth, but I worked until the day before I gave birth. Haven’t I experienced morning sickness or prone to miscarriage in the first three months?”

“I threw up until the sixth month, but I still insisted on going to work, even working overtime and travelling. When the company was in the business expansion period and needed to go to overseas universities for recruitment, I was only in my third month of pregnancy and I didn’t even have time to get jet lagged. I bounced around several famous universities in Europe and America, once I even had signs of pre-miscarriage, but didn’t I still survive? I didn’t even take a single day off.”

With these words, she stood on the high moral ground, and Dai Qin was so embarrassed that tears of shame pooled in her eyes.

Comparing the two, she seems so much worse than Li Wanjun, who was also a pregnant woman once.

Du Xinyi also took the opportunity to throw out an ultimatum, “Therefore, according to the labour law, if a labour contract is concluded or changed against the true intention of the other party by fraudulent means or by taking advantage of others, the labour contract is null and void. Miss Dai, since your contract with Guifeng Communication is null and void, the labour relationship is naturally null and void as well.”

This sounded like a complete and reasonable chain of evidence, and Du Xinyi and Li Wanjun looked at each other with a smile of mutual satisfaction already on their face, while Ji Lin, who had been sitting beside herself and listening quietly, finally looked at Bai Duanduan. His expression was indifferent and his beautiful eyelashes blinked gently, “I don’t think I need to say anything today.”

After hearing this, Du Xinyi was almost arrogantly proud of herself. Ji Lin and Bai Duanduan were nowhere better than her. Now that the evidence was complete, weren’t the two of them defeated by her?

Not to mention Bai Duanduan, even Ji Lin, in the face of her own proposal, could only dumbly surrender, and did not even know where to start with the words of rebuttal.

She was just about to say a few sarcastic words when she heard Ji Lin indifferently continue to say to Bai Duanduan.

“You can solve the following matters by yourself. This difficult negotiation doesn’t need me to do anything at all.”

Ji Lin’s expression didn’t hide his emotions at all, “This is too boring” almost hung on his face like a banner. He looked at Bai Duanduan again, “You can manage it, right?”

When Ji Lin looked at people seriously like that, his eyes really looked beautiful. The sense of professional superiority and contempt  that this man had at the moment did not make people feel uncomfortable at all, because Bai Duanduan knew that Ji Lin really deserved this sense of superiority and contempt.

Bai Duanduan couldn’t help but smile as she nodded to Ji Lin, “Yes. I don’t need you to do anything, I’m good enough. Just have to waste some of your time sitting and listening through.”

After she finished, she then turned her head to look at Du Xinyi. When she learned that Guifeng Communication wanted to rely on Dai Qin’s concealment to prove the fraud and claim that the contract was invalid, Bai Duanduan had already prepared for everything as the lawyer should have already prejudged all possible scenarios when she sat down at the negotiation table. Previously, Bai Duanduan’s loss and gullibility in the face of Ji Lin had taught her enough lessons and growth, so even if now Du Xinyi could prove that Dai Qin had indeed concealed the pregnancy, Bai Duanduan was not frazzled.

Bai Duanduan met Du Xinyi’s provocative gaze and took out the information she had prepared long ago, “This is Dai Qin’s employment contract. The job description of which is that of an employee of the Marketing Planning Department. It requires Dai Qin to be responsible for marketing activities such as writing advertisements for the company; and this one, is a screenshot of the notarised information I took from the job advertisement for the position originally published by your company on the recruitment website. It describes Dai Qin’s job content for the position in more detail and clarity.”

“First, be responsible for the external publicity and update of the company’s website; second, grasp all the information of the company’s new products and related projects and formulate targeted strategy to promote them; third, review relevant product and project information and collate them into a book; fourth, draft the feasibility report of marketing planning activities and organise related project activities; fifth, discuss and communicate with project departments and complete the writing of corresponding planning and marketing instruments; sixth, organise the planning of thematic promotions.”

Bai Duanduan glanced at Du Xinyi, then continued to read, “As for the qualifications, it is also mentioned very clearly that it requires a  Bachelor’s degree in Management or a Bachelor’s degree in Chinese, a keen insight into the market, good writing and creative conceptualization skills, excellent communication skills and a sense of responsibility…..”

Du Xinyi frowned and interrupted Bai Duanduan with an impatient look on her face, “What are you reading these things for? This is a professional negotiation, don’t think you can muddy the vision by bringing in this mess of information.”
