Chapter 6.3 Please don’t throw garbage at my doorstep in the future

Bai Duanduan can actually understand his frustration and irritation. She has handled so many labor disputes. Except for a very small number of cases where the fault was entirely on the part of the company or the worker, in 80 to 90 per cent of the cases, neither the company nor the worker was innocent.

Now that Jin Guang Electronics’ attitude was so fierce and as they keep on insisting that Xu Zhixin was faking sick leave. It can be seen that Xu Zhixin was not completely flawless. He does have some physical discomfort,  but he was not uncomfortable to the point where he needs to take sick leave so frequently. His leave slip, in a high probability, was indeed a bit tricky to be true, but if the law approves it, then the company will have to pay for it.

The “Labor Law” cannot provide detailed provision on all possible matters  in the field of labor disputes. It can only give priority to protecting laborers who are usually in a disadvantaged position in labor disputes from a general direction. There was nothing wrong with such legislative norms.

Bai Duanduan thought of her father, and felt that the “Labor Law” was not completely correct, and sometimes the protection of laborers was not comprehensive enough. If the “Labor Law” could be more perfect, it would not have been so difficult for her own family. Her father, maybe wouldn’t have had his leg amputated at all…

The fact was that Bai Duanduan has always had a natural compassion for workers because of what happened to her father. Even though workers like Xu Zhixin may have flaws, Bai Duanduan still thinks that individual workers were weak compared to enterprises and should be protected.

From the standpoint of a lawyer, it was only important for her to support her client.  As a lawyer, she does not need to find out the truth. She only needs to fight for the benefit of her client within the legal limits. Lawyers do not have a position, they only need to be professional.

Now compared to Xu Zhixin’s trepidation, Bai Duanduan was calm and collected, “Even if a company refuses to accept the verdict and make an appeal to the court, it must have reasons and evidence to apply for revocation of the arbitration award. According to the current evidence chain, if they go to court, the result will not be any different.” She glanced at Xu Zhixin and added, “Unless the other party finds new evidence that can prove that you did cheat on your sick leave.”

Xu Zhixin stumbled and tried to explain again, “I……I really didn’t ……”

“As long as there is no new evidence to prove that your sick leave is fake, legally you are innocent.”

Xu Zhixin nodded. He was still in poor spirits, very dry and withered in description, and now with this still gloomy and shrouded result of the winning case, even more sad. The verdict of the case left him more frowning.

He was about to say something more when his mobile phone rang. Bai Duanduan didn’t know what was said on the other end of the line, but after he hung up, Xu Zhixin’s already hunched back, seemed to be weighed down by an invisible weight.

When Bai Duanduan offered to drive him to a nearby subway station, Xu Zhixin silently sat in the car and didn’t speak a word. As Bai Duanduan turned at the corner, she subconsciously glanced in the rearview mirror and realised that Xu Zhixin, who was sitting in the back of the car, was silently crying.

He noticed Bai Duanduan’s gaze, and hurriedly wiped his tears with the back of his hands.

Bai Duanduan was shocked but couldn’t resist saying, “There are tissues in the back.”

Xu Zhixin choked up and said, “Thank you.”

Because of the traffic jam, the car moved very slowly, and the awkward and strange silence in the car was abnormally amplified. Just when Bai Duanduan was considering whether to play a song to ease the atmosphere, Xu Zhixin finally spoke again——

“My dad is dying.”

The tall man couldn’t stop the pain and sadness in his voice when he mentioned his seriously ill father,”I’m a useless person, I’ve never let my father live a good day in his life, except for making him work and suffer for me.”

Perhaps once the valve of confession was opened, it became easier to speak again. Xu Zhixin took a deep breath “Our family is from a rural area, and the conditions have always been very difficult. Mom died very early. It was my dad who brought me up. I was admitted to the town’s High school all the way because of my good grades in the village. My dad pieced together every penny to send me to High School. I worked hard and got a scholarship, and finally went to a university to study Electronic Mechanics. I thought that as long as I struggle through this stage, I would just get ahead .”

“I even made a few small inventions of mechanical devices in college. I was very optimistic at the time. I thought I could get a job after graduation and give my dad a good life. It’s just that I didn’t expect that those good jobs are nothing nowadays. Academic qualification can be counted as a stepping stone to get into the industry. I’m a rural person, without any background and contacts. To be honest, the university I went to is not top-notch. In the end I can only go to a technical post that others refuse to go to. I have to leave for the workshop every day. Everytime  I go home from work, I have to wash my hands for ten minutes to wash off the oil stains in my nails so that my dad will not find me as a college graduate who works at a workshop…”

Xu Zhixin laughed in self-mockery, “I lied to my dad that I was in the office. He thinks it was the kind of white-collar workers he always saw on TV, entering and leaving high-end office buildings. Originally I wanted to pay off the tuition debt when I went to college, so that my dad could live a good life. But later, we found out that he have advanced pancreatic cancer…”

After that, Xu Zhixin couldn’t say anymore, and he fell into a series of choking sobs, “Lawyer Bai, I can’t be proven guilty of faking sick leave, otherwise I won’t be able to find a new job at all. I have to hold my family together.”

Bai Duanduan looked at the traffic jam in front of her and at Xu Zhixin, who was weeping in the car. Her heart flustered and had some empathy and sadness. Although it was not as difficult as Xu Zhixin’s situation, Bai Duanduan has indeed experienced a similar situation…

“Let me confirm with you again. Are there any problems with the sick leave slips and diagnosis certificates you provided? Can you prove its validity if I go to the hospital to check?”

Xu Zhixin paused, “Although I have been ill intermittently, I really did not pretend to be sick. My dad was diagnosed with cancer at that time. I was very stressed and could hardly sleep. My body became very poor. I did continue to have allergies, hives and gastrointestinal tracts. I still have a cold, and I still go to the hospital for IV drips.All these sick leave slips and diagnosis certificates are issued by different departments…”

Uneasily, Xu Zhixin also said “At that time, the Director of Personnel department felt that I had faked my illness. After all, who would want to get into a mess of illnesses? I also didn’t want to but at that time it was the same as hitting evil. This illness was connected to the other disease. I was also mentally stressed and in trance I broke my leg…”

“But I’m really sorry for Sister Yan Xin. In recent years, the electronic machinery and equipment market has not been very good. She was the first to recruit me and offer me such a high salary. She also withstood the pressure. It was I who had let her down…” Xu Zhixin smiled bitterly, “No one will believe such frequent leaves.”

Bai Duanduan was originally skeptical of Xu Zhixin’s frequent sick leave, but now after listening to his explanation, she can’t help but feel a little sympathetic.

When life suffers a major blow, the body suddenly falls into an instant high fever, but it so happens that Xu Zhixin’s room leaks at night when it rains, Bai Duanduan also gritted her teeth at his unpleasant situation.

People who haven’t experienced these pains don’t know, and probably will never be able to imagine how unfortunate a person can be. The misfortunes are so dramatic and full of coincidences that it is too bad to be real.

Originally, Bai Duanduan was only looking at the case from the standpoint of work, but now, in addition to her work, she privately, also wanted to help Xu Zhixin.
